H-2B Cap Reached for First Half of FY 2006

USCIS has announced that it has received sufficient numbers of cap-subject H-2B petitions to reach the congressionally mandated cap of 33,000 for the first half of Fiscal Year (FY) 2006. Cap-subject H-2B petitions requesting employment start dates of March 31, 2005 or earlier that were not received on or before December 15, 2005 will be rejected. Petitions received on December 15 will be subject to a computerized random selection process; petitions not selected during this process will be rejected. Note that USCIS will continue to accept cap-exempt H-2B petitions, as well as cap-subject petitions requesting employment start dates of April 1, 2005 or later.
