The H1B Cap for Fiscal Year 2009 has been met within the first five business days, U.S. Citizenship and Immigration Services (USCIS) announced today. The H1B Master’s Cap has also been reached inside the five day period. USCIS has not announced the date for the random selection process which will be conducted once the initial data entry for all filings received has been completed. The final day of receipt is April 7, 2008.
USCIS will conduct the selection process for H1B Master’s quota, which has a cap of 20,00 first. All “advanced degree” petitions not selected will be part of the random selection process for the general H1B cap of 65,000. All cap subject applications that are not selected in the random selection process will be rejected and filing fees retirned. Multiple filings will be rejected and handled as per the new rules.
